Conditions Générales de Vente et de Services / CGVS

These Terms and Conditions of Sale and Service govern the relationship between HuitCents and any individual or legal entity wishing to benefit from the design of custom websites and/or the monthly subscription to the services offered.

HuitCents.

HuitCents offers digital services suited to many industries, including:

• The creation of a custom website.
• A monthly subscription for maintenance and advanced features (details below).

These services aim to provide a turnkey platform, without the Client having to manage the technical side.

Website

• The company designs custom websites tailored to the needs, goals and preferences expressed by the Client. This service is offered with no commitment: no payment is required until the Client has approved the presented version.
• The Client may review the proposed site, request adjustments and confirm satisfaction before purchasing. No fee will be charged without their explicit agreement.
• However, full delivery of the site is conditional upon full payment of the agreed amount. No site may be obtained for free or delivered without payment.
• This process lets the Client ensure the site meets their expectations before any financial obligation.

Delivery times

• The company strives to deliver websites as quickly as possible.
• However, timelines may vary depending on several factors, including project complexity, the number of requested changes, the Client's responsiveness, and the current order volume.

Monthly service subscription

After purchasing the website, the Client may subscribe to an optional monthly plan billed at €49 per month, with no commitment, including the following services:

• Technical maintenance (updates, bug fixes, SEO optimization)
• Unlimited video hosting with smooth playback and resume
• Access to a personalized dashboard to manage statistics and settings
• Marketing automation tools (emailing, SMS follow-ups)
• Responsive support 7 days a week.
• Secure hosting.
• Access to a private community (in development, on Discord)

The Client may subscribe or cancel this plan at any time, without notice or justification. Cancellation takes effect at the end of the current monthly period. No refund is issued for the period already started.

Refund policy

• Websites: no amount is due until the Client has approved the site. Once approval is confirmed, no refund is possible.
• Subscription: no refund is granted. Cancellation is immediate for the following months.

Intellectual property

• Until full payment for the project has been made, all elements of the site remain the exclusive property of the company.
• After payment, the usage rights to the finalized site are transferred to the Client, except for third-party elements used under license (fonts, plugins, third-party tools, etc.) and technologies proprietary to the company.
• Internal tools, technical systems and software infrastructure developed by the company remain its exclusive property, unless otherwise agreed in writing.

Client obligations

• The Client undertakes to provide accurate and complete information, to communicate within reasonable timeframes, and to clearly validate the project's milestones.
• The Client is solely responsible for the content provided (text, images, videos, legal notices) and for its compliance with applicable laws (copyright, image rights, sector-specific legal obligations, etc.).
• The company reserves the right to refuse any content that is unlawful, contrary to public decency, or contrary to its ethical values.

Liability and warranty

The company undertakes to provide a functional and secure site. However, its liability cannot be engaged:

• In the event of misuse of the site by the Client
• In the event of a failure related to a third-party service
• In the event of temporary unavailability of the site for maintenance or force majeure

The company's financial liability, in the event of proven damage, is expressly limited to the amount actually paid by the Client for the service concerned.

Personal data

The data collected is used solely for project management, billing and customer support. It is in no case resold to third parties.

Termination

• The Client may cancel their monthly subscription at any time, free of charge, by a simple written request or from their personal account, if available. Cancellation is effective at the end of the current monthly period.
• In the event of a serious breach of these Terms (notably repeated non-payment, abusive behavior, unlawful use of the site), the company reserves the right to unilaterally suspend or terminate any service provided, without notice.

Changes to the terms

• The company reserves the right to amend these Terms at any time.
• Any update will be published on the website. Changes take effect immediately, unless otherwise stated.
• Continued use of the services after a change constitutes acceptance of the new Terms.

Confidentiality

Confidential information exchanged between the parties during the project (strategies, content, data, technical access, etc.) is strictly protected. No information may be used for other purposes or disclosed to third parties without the prior agreement of the party concerned, except where legally required.
